Appellate Division upholds chamber judge’s order staying Zayed’s candidacy

The Appellate Division of the Supreme Court today upheld its chamber judge’s order staying the High Court directive that halted the Appellate Board’s decision cancelling the candidacy of Zayed Khan and declaring film actress Nipun as the general secretary of Film Artistes’ Association.

The apex court also extended the chamber judge’s order that on February 9 also issued status quo on holing the office of general secretary of the association, saying that nobody can enter the office till further order.

The SC also asked the lawyers of both sides to hold hearing at the HC on the rule over this issue tomorrow (Tuesday) as per schedule.

A full bench of the Appellate Division headed by Chief Justice Hasan Foez Siddique passed the order after hearing a leave to appeal petition filed by Nipun challenging the HC order.

Lawyers Rokanuddin Mahmud and Mustafizur Rahman appeared for Nipun while lawyer Ahsanul Karim, accompanied by lawyers Yusuf Hussain Humayun and Nahid Sultana Juthi, argued for Zayed Khan during virtual hearing of the appeal today.

Following a writ petition of Zayed Khan, the HC on February 7 stayed for a week the Appellate Board’s decision that cancelled his candidacy.

The HC also issued a rule asking the authorities concerned of the government and Appellate Board, and Nipun to explain why the appellate board’s decision should not be declared illegal and also set February 15 (tomorrow) for hearing on the rule.

Earlier, Nipun had lodged a written complaint towards the Chairman of the Appellate Board, asking for the cancellation of both Zayed Khan and Chunnu. The Ministry of Social Welfare looked to the Appellate Division to mitigate the situation.
